Eligibility to Sponsor Other Relatives

There are several eligibility criteria to sponsor a relative like a nephew, niece, uncle, and aunt. The sponsor should be:

  • Having Minimum Necessary income
  • At least 18 years of age or more
  • A Canadian citizen or permanent resident
  • Residing in Canada
  • Free from debt or bankruptcy proceedings
  • Ready to submit the sponsorship application with all forms and documents
  • Prepared to accept the obligations of undertaking
  • Free from any restrictions of removal orders
  • Free from any criminal convictions

Duration of Undertaking

The undertaking to sponsor your other relatives to Canada is of ten years duration. The period of ten years begins as soon your relative becomes a permanent resident of Canada. The relative will not have any access to social assistance for this period. A sponsor will have to pay the amount back to the government if they receive any social assistance.

The undertaking extends to a spouse or child of your relative. The facility of social assistance to the disabled will not affect the sponsorship application.

The sponsor should be a lonely person having no spouse or common-law partner. However, one need not be a lonely sponsor if the relative is below 18 years of age and an orphan.

Bankruptcy and Criminal Sentences

Sponsoring other relatives is not allowed if the sponsor is filing for bankruptcy. One can only obtain eligibility to sponsor the relative after the discharge of bankruptcy. It is better to seek the guidance of a bankruptcy consultant to know your options.

Similarly, a criminal conviction can also disqualify you from becoming a sponsor for another relative. Most restrictions depend on the severity of the crime. However, the sponsor may obtain eligibility if the sentence is more than five years old and has no past criminal record outside Canada for the same period.

Sponsoring Siblings

There are alternative options to sponsor your brother or sister below 18 years of age and have lost both parents. You must quality as a sponsor by fulfilling or standard criteria mentioned above. However, you may sponsor your brother or sister who is more than 18 years of age if you are a lonely sponsor. A lonely sponsor does not have:

  • Mother
  • Father
  • Child
  • Spouse
  • Common-law partner
  • Conjugal partner
  • Grandparents

It is possible to seek humanitarian and compassionate grounds if you are not eligible to sponsor a sibling who is more than 18 years of age. Alternatively, you may explore other possibilities like:

  • Option to study in Canada- Immigration to Canada through a study permit is a good option. Supporting your sibling financially or helping them complete the application process for a study permit are ways to assist your sibling in the immigration process.
  • Being a business partner-Successful business owners can use the option of securing a work permit provided they are eligible for the program.
